Apple and Intel Join Hands to Sue Softbank-Backed Firm over Meritless Patent Lawsuits

Apple joined hands with chipmaker Intel and filed a lawsuit against Fortress Investment Group, a Softbank-backed firm, on Wednesday. The firms allege that Fortress Investment Group hoards patents and has used them to pursue meritless patent litigations against big tech companies, violating federal antitrust laws in the US.

Both Apple and Intel claim that the Softbank Group firm has demanded as much as $5.1 billion from various tech firms over the years. Intel had first filed a lawsuit against Fortress back in October but later withdrew it, only to team up with Apple and submit a newer version of the lawsuit yesterday. The latest lawsuit was filed with the District Court for the Northern District of California.

The Cupertino and Santa Clara-based tech firms allege in the lawsuit that Fortress does not make any product. However, it uses the patents it owns and the patents of the firms it owns for the sole purpose of suing other tech firms and demanding millions of dollars. By doing so, Apple and Intel allege that Fortress has caused them significant economic harm in the form of litigation costs and various other legal resources.

It is mentioned in the lawsuit that various firms connected to Fortress Investment Group have filed as many as 25 lawsuits against Apple and demanded up to $5.1 billion. The complaint also claims that companies like Fortress pursue various patent litigation lawsuits aggressively and even if they lose most of the cases, they usually end up winning a case amounting to a sum of money that exceeds their losses.

Fortress owns firms like DSS Technology Management, Seven Networks, Uniloc Luxembourg, and Uniloc USA. The two Uniloc firms say that they are entitled to at least $1.41 per Apple product because the iPhone maker violated their patent, which is related to step counting in health tracking apps. However, Apple reiterated that these claims were bogus and that Uniloc Luxembourg and Uniloc USA used the amounts that Apple sought from Samsung in the Apple vs. Samsung patent infringement lawsuit.

Back in October, a Fortress spokesperson had mentioned it to Reuters that the company was confident in its business practices and legal position.
